New law allows the sale of ADUs

NORTH COUNTY — A new law allows accessory dwelling units to be sold as condos separate from a primary residence but with certain conditions.

Authored by Phil Ting (D-San Francisco), Assembly Bill 1033 give any city or county the ability to opt-in to allow for-sale ADUs as long as the units are constructed by a qualified nonprofit corporation, among other conditions. However, the individual selling the ADU must create a homeowner’s association as the lot will be split.

Supporters of the law say it will address more supply for residents as the current median home price is $800,000, according to the U.S. Census Bureau. Only 17% of households can afford to purchase a median-priced single-family home, the California Association of Realtors said.

In San Diego County, the median sale price of a single-family home in December 2023 was $911,500, per CAR. Home prices increased 7.2% year-to-year in the county.

As for condos, the median price is $635,000 in December 2023 compared to $587,000 in December 2022, CAR reported.
